DEFINITIONS
"Administrator" means 360insights, programme administrator
"Participant" is defined as Retail staff eligible to sell FOSSIL Group products who have accepted these Terms and Conditions of Use.
"Programme" is defined as FOSSIL Rewards and all its component parts.
"Website" is defined as www.fg-rewards.com
These Terms and Conditions of Use apply to FOSSIL UK Ltd’s Fossil Connected programme.
ACCEPTANCE
By accessing, transacting points, or using any aspect of the Programme or Website, the Participant agrees to be bound by these Terms and Conditions of Use and the terms, conditions, disclaimers and limitations of liability posted in the rewards page by the Administrator on the Website. FOSSIL UK Ltd reserves the right to amend or update any of the Terms and Conditions of Use at any time without providing notice to the Participant. By using the Website, the Participant acknowledges that they have read and understood these Terms and Conditions.
ELIGIBILITY
This Programme is open to Participants who are a resident in UK and Ireland and are 18 years of age or older at the time of entry. Employees must obtain the prior permission of their employer to participate in this scheme. This Programme cannot be combined with any other FOSSIL UK Ltd Programmes, offers or rebates.
The Programme and its benefits are offered at the discretion of FOSSIL UK Ltd and its affiliated companies, and has the right to terminate the Programme or to change the Programme terms and conditions, rules, benefits, conditions of participation or rewards levels, in whole or in part, at any time, with or without notice, even though changes may affect the value of the Rewards Points already accumulated. It is the Participant’s responsibility to maintain its knowledge of these terms and conditions.
Employees of FOSSIL UK Ltd, their affiliated companies, advertising agencies, gift suppliers or other representatives, or members of the respective immediate families of such employees and anyone with whom such employees are domiciled are not eligible to participate in sales related Programmes. Employees of FOSSIL UK Ltd are eligible to participate in employee reward or recognition Programmes.
TO PARTICIPATE
In order to participate in the programme, Participants are required to sell any Fossil Group watch traditional or connected, or jewellery, which includes both full price and discounted products. The Fossil Group brands included are: Fossil, Skagen, Michael Kors, Emporio Armani, Armani Exchange, Kate Spade Diesel and DKNY.
Where Participants are required to log details of their sales on the programme Website, sales will be subject to approval and FOSSIL reserve the right to decline any claims deemed false or inaccurate.
Participants will receive points for each Fossil Group product sold. Points awarded vary depending on the price of the watch or jewellery sold. Points are awarded based on the actual sale price, not the RRP. Watches sold under £150 receive 1 point. Watches sold between £150 and £250 receive 3 points. Watches sold over £250 receive 10 points.
Prizes will be delivered to the Participant’s place of work unless otherwise stated. Please allow up to 14 working days for delivery of prizes.
No prize should be exchanged or sold and prizes issued are intended in goodwill for the participant to wear or gift.
FOSSIL UK Ltd is not responsible for lost, corrupted or delayed entries. Participation constitutes full and unconditional acceptance of these Terms and Conditions. Any failure to follow Programme terms and conditions, any abuse of the Programme, any conduct detrimental to the interests of either FOSSIL UK Ltd or the Administrator, or any misrepresentation of any information furnished to FOSSIL UK Ltd may result in the termination of his or her participation, the cancellation of accrued points, rewards or benefits, or both.
TIMING
The incentive will run from 1st October 2023 to 31st December 2023. Any sales made outside of these dates will not be valid.
Participants will have until 28th February 2024 to claim any sales made during the incentive..
Participants will have until 31st March 2024 to claim any prizes using their accumulated points. All points will be voided and any points left unspent on your account will be removed after 31st March 2024.
USE OF DATA
Personal data which you provide when you register for the Programme may be used for Programme communications and future FOSSIL UK Ltd marketing activity. If you agree to this use, please tick the ‘accept terms and conditions box’ on the Programme website.
OTHER
Programme termination
FOSSIL UK Ltd or The Administrator reserves the right in its sole discretion to cancel or suspend the Programme at any time.
Registered participants will be given written notice of Programme termination and all points must be redeemed 30 days following notification of the end of the Programme.
Tax
Some prizes and rewards may be considered a taxable benefit to the recipients and may give rise to tax or National Insurance or other local tax implications.
FOSSIL UK Ltd has set up a Taxed Award Scheme and, at its own discretion, will pay the basic rate tax liability and National Insurance contributions arising on rewards at £500 or over on behalf of employees. If you are a higher rate tax payer it is your responsibility to declare the difference on your tax returns.
FOSSIL UK Ltd retains the right to withdraw this Taxed Award Scheme in the future and if this situation arises then employees will be given notice of this change. There is not an employee contractual right in this respect.
FOSSIL UK Ltd and The Administrator will absolve themselves from any liability arising from any tax or National Insurance Contributions arising from prizes won under £500. Recipients are directly responsible for accounting for and paying to their local tax offices any tax liability and NI contributions or other local taxation arising on their prize.
General
No correspondence will be entered into regarding either this scheme or these Terms and Conditions. In the unlikely event of a dispute, FOSSIL UK Ltd’s decision shall be final. FOSSIL UK Ltd and/or The Administrator reserve the right to amend, modify, cancel or withdraw this scheme at any time without notice.
FOSSIL UK Ltd and/or The Administrator cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Participants in this incentive scheme agree that FOSSIL UK Ltd and The Administrator will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of a prize, or from participation in this promotion. Nothing in this clause shall limit FOSSIL UK Ltd’s or The Administrator’ liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
